Conduct Review Sub-Committee Agreements

Where a citation has been issued and the parties reach an agreement on all issues, the matter can be referred to the Conduct Review Sub-Committee. This Sub-Committee, comprised of three Council members, one of whom is a layperson, has the authority to review agreed statements of fact and disposition and either approve or reject them.

  • Lapointe, Marc Jacques (Certificate Issued: 2001.05.23)

    admitted to professional misconduct and conduct unbecoming a member of the College. On June 12, 2008, the Conduct Review Sub-Committee accepted the Statement of Agreed Facts and Disposition and agreed to a relinquishment of Mr. Lapointe’s certificate of qualification and his undertaking to never reapply for a certificate or membership in the College. The Sub-Committee was satisfied that the facts of the case not be disclosed as publication would lead to an adverse effect through identification of those involved.

  • Belec, Gordon Frederick Joseph

    was employed as a secondary school teacher when he became involved with a grade eleven female student in the 2005/2006 school year. Mr. Belec and the student began a friendship in secret by communicating with each other by email and text message. When the student informed Mr. Belec that she had stronger feelings for him, he took no steps to dissuade her from acting on her feelings, but rather intensified the relationship. As a consequence, Mr. Belec was arrested in 2007 and charged with sexual exploitation contrary to section 153(1)(a.) of the Criminal Code of Canada. He pled guilty to the charge of sexual exploitation on April 2007, and was sentenced to 14 days in jail and 18 months of probation with conditions. Additionally, Mr. Belec was ordered to be registered on the Sex Offender Information Registry. On October 5, 2009, the Conduct Review Sub-Committee accepted the Statement of Agreed Facts and Disposition and Mr. Belec’s acknowledgment that his conduct constituted conduct unbecoming a member of the College. It was agreed that Mr. Belec not be issued Certificate of Qualification for an indefinite period of time. Mr. Belec’s College teaching certificate was cancelled on November 1, 2008 for non-payment of fees.

  • Henley, Michael David

    admitted that his conduct in committing sexual assaults and indecent assault for which he was convicted constituted conduct unbecoming a member of the College. On June 16, 2004, the Conduct Review Sub-Committee approved the Statement of Agreed Facts and Disposition. Council determined that the respondent be barred from membership for an indeterminate period of time.

  • Hooper, Joshua Paul (Certificate Issued 1998.08.25; cancelled in 2004 for non-payment of fees)

    admitted to professional misconduct. From September 1999 to February 2003, Mr. Hooper taught Grades 1 and 2 at an independent school. Mr. Hooper admitted that he inappropriately touched a student in his Grade 1 class more than once in February 2003, by placing his hand under her waistband in the area of her abdomen. Mr. Hooper further admitted that during the 2002/2003 school year, he touched another student by placing both hands inside her underwear. Further, he admitted that in December 2003, he tickled a student on her stomach while using his free hand to roll down her waistband at the back of her pants. On February 13, 2008, the Conduct Review Sub-Committee found the member guilty of professional misconduct and agreed that the appropriate penalty be that the member not be issued a Certificate of Qualification for a period of 50 years.
